These Terms of Service ("Terms") govern your use of motkit.com (the "Site") and your purchase of products from MOTKIT ("we," "us," or "our"). By accessing our Site or placing an order, you agree to be bound by these Terms.

2. Account & Orders

2.1 Account-Free Shopping

Motkit uses email-based authentication — no password required. Your order history is linked to your email address. You are responsible for maintaining the security of your email account.

2.2 Placing an Order

When you place an order, you are making an offer to purchase the products in your cart. All orders are subject to acceptance and availability. We reserve the right to:

  • Refuse or cancel any order at our discretion
  • Limit quantities per customer or per order
  • Cancel orders suspected of fraud, unauthorized use, or pricing errors

2.3 Order Confirmation

An order confirmation email acknowledges that we have received your order. It does not constitute acceptance of your order. Acceptance occurs when we ship the product and send you a shipping confirmation email.

2.4 Order Cancellation

  • Within 60 minutes of placing an order: You may cancel through our Site or by contacting us
  • After 60 minutes: Contact us at support@motkit.com — we will attempt to cancel if the order has not entered processing
  • After shipping: Orders cannot be cancelled. See our Returns & Refund Policy for return options

2.5 Order Cancellation by Motkit

We may cancel orders in the following situations:

  • Product is out of stock or unavailable
  • Pricing or product information error
  • Suspected fraudulent or unauthorized transaction
  • System error or technical malfunction

If we cancel your order, we will notify you and issue a full refund within 3-5 business days.

3. Pricing and Payment

3.1 Pricing

All prices are displayed in the currency selected at the time of browsing (USD or CAD). Prices include applicable product costs but exclude shipping, taxes, and customs duties (where applicable).

We strive to ensure pricing accuracy. However, errors may occur. If a product is listed at an incorrect price, we may cancel the order and notify you.

3.2 Payment Methods

3.3 Payment Processing

  • Payment is charged immediately upon completing your order
  • Credit card payments are processed through Airwallex (PCI-DSS compliant)

  • We do not store your complete credit card information

3.4 Taxes

Applicable sales tax is calculated based on your shipping address and displayed at checkout. Canadian orders may be subject to GST/HST/PST depending on your province. Customs duties and import taxes for Canadian orders are the responsibility of the recipient and are not included in our prices.

Shipping rates, delivery times, and tracking are governed by our Shipping Policy. Key points:

  • We ship to the United States and Canada
  • Free shipping on orders over $79 (US) / $99 (Canada); areas requiring remote delivery or fuel surcharges excluded
  • Orders processed within 2 business days
  • Standard delivery: 5-10 business days (US), 7-14 business days (Canada)

5. Returns and Refunds

Returns and refunds are governed by our Returns & Refund Policy. Key points:

  • 30-day money-back guarantee from the delivery date
  • Quality-related returns: we cover shipping costs
  • Non-quality returns: customer pays return shipping
  • Refunds issued to the original payment method

13. Dispute Resolution

These Terms are governed by the laws of the United States, without regard to conflict of law principles.

13.2 Dispute Handling

If you have a dispute, please contact us first at support@motkit.com. Most issues can be resolved directly through our customer support team.

13.3 Binding Arbitration

If we cannot resolve a dispute informally, you agree to resolve it through binding arbitration rather than in court, except that you may assert claims in small claims court if your claims qualify. Arbitration is conducted on an individual basis — class actions and class arbitrations are not permitted.

13.4 Time Limitation

You must bring any claims within one (1) year from the date the cause of action arose. Claims not brought within this period are permanently barred.

14. Privacy
